On December 29, 2023, the UN International Court of Justice was asked by South Africa to "provisionally" halt Israel's military operations in Gaza - unconditionally - on the grounds of suspected acts of genocide.
Although we cannot anticipate the Court's forthcoming decision, which will necessarily have political connotations, South Africa's reasoning does not hold up if we take into account the case law on the Convention on the Prevention and Punishment of Genocide. Here's why!
